This Terms and Conditions agreement has been adopted between the user and the Dakatra Application. It governs your use of the Dakatra app and all related services. Please read these terms and conditions carefully before using the application. Your use of the application constitutes your acceptance of all terms and conditions set forth in this agreement.
Introduction
The Dakatra application aims to provide diverse and reliable medical services to users by connecting them with qualified and trusted doctors and healthcare providers. This agreement includes the terms and conditions that define your rights and obligations as a user of the Dakatra application, in addition to the privacy policy applicable within the app.
You must accept all terms and conditions mentioned here before using the application. If you do not agree to any provision of these terms, please refrain from using the application.
Intellectual Property Rights
The Dakatra application retains all intellectual property rights related to the application and the content available on it, including but not limited to trademarks, copyrights, and patent rights.
Copying, distributing, transmitting, selling, or exploiting any part of the application or its available content in any form is prohibited without obtaining explicit permission from the Dakatra application. In the event that the user commits such a violation, the Dakatra application management has the right to seek legal compensation.
Limitation of Liability and Disclaimer
The application's services and content are provided on an "as is" and "as available" basis. The Dakatra application offers a range of services including, but not limited to, booking doctors, laboratories, remote consultations, and emergency services. This content is presented to users to facilitate bookings and appointments with service providers, and the application disclaims responsibility for the quality of services provided or errors resulting from third parties.

We make every effort to ensure the accuracy and reliability of the information provided through the application, but we make no express or implied warranties regarding the quality of services or their suitability for any particular purpose. Users bear full responsibility for their use and evaluation of the services available in the application based on their own judgment.
In general, Dakatra is not responsible for any direct or indirect, consequential, incidental, special, or punitive damages, including loss of profits or data, or any other loss arising from the use of the application or the inability to use it, whether based on legal, contractual, or other liability, even if we have been notified of the possibility of such damages.
Or with respect to any of the following actions committed by service providers:
- Failure to provide proper patient etiquette and respect for patient privacy.
- Unprofessional, unethical, or disgraceful conduct in dealing with patients.
- Incorrect or delayed diagnosis of a medical condition.
- Providing incorrect or delayed treatment, or absence of appropriate treatment.
- Medical malpractice or negligence in providing medical services.
- Cancellation of an appointment, delay of the service provider, or complete failure to attend scheduled examination appointments.
- Underestimating the likelihood of infection transmission to a patient in cases where the patient has a contagious disease or virus in clinics.
Please be aware that the Dakatra application does not provide medical advice, does not diagnose or treat, and does not guarantee the quality of services provided by service providers. Users must bear full responsibility for their use of the application and reliance on the information provided therein.
Please note that the Dakatra application bears no responsibility for any material or moral damages, deaths, injuries, illnesses, losses, costs, or expenses of any nature resulting from service providers registered in the application. Users are advised to exercise caution and make appropriate decisions before using the services of registered providers, and to verify their eligibility and competence to meet their healthcare needs.
Based on all of the above, we urge users to take the necessary precautions and seek professional advice before making any decision or taking any action based on the information or services available in the application.
The application reserves the right to change or update the terms and conditions of use at any time without prior notice. Users should periodically review the terms and conditions to be aware of any new changes.
Damage caused by third parties: Appointments, consultations, or third-party services are provided through the application. Although we endeavor to offer reliable services and entities, we bear no responsibility for services provided through the platform, and the user bears full responsibility for their use of those services. The application also disclaims any liability in this regard.
Electronic Viruses and Technical Damages:
The Dakatra application makes every effort to maintain the safety of the application and protect against viruses, spyware, and other technical damages. However, it cannot guarantee the absence of any technical damages affecting users' devices, and therefore the application disclaims any responsibility for such damages.
Accuracy and Errors: The Dakatra application strives to provide accurate and reliable information, but does not fully guarantee the correctness or accuracy of the information. The user bears full responsibility for using the information provided and making appropriate decisions based on it.
Jurisdiction:
In the event of any legal dispute or disagreement arising from your use of the "Dakatra" application, you agree that the jurisdiction for resolving such disputes shall be the courts of Cairo, Arab Republic of Egypt. Accordingly, you acknowledge and agree that any lawsuit or legal proceeding related to the application or its use must be filed before the competent courts in Cairo.
In addition, you agree to waive any other jurisdiction that may be available in relation to such disputes. This means you waive any right to transfer the dispute to a court in another location or to use an arbitration mechanism.
Please note that this clause establishes the exclusive jurisdiction of the courts in Cairo and excludes any other venue for adjudicating disputes. This is done to provide and ensure a fair and appropriate judicial process in the event of any dispute arising from the use of the application.
Electronic Payment:
Under your agreement with us, you may pay in cash upon delivery of the medical service, or via electronic payment available through our application using a credit card, instant payment services, or digital wallets. We collect the amounts due on behalf of service providers, and by this agreement you expressly agree to comply with the payment terms specific to each service.
You agree to make all payments in a timely manner as specified, and acknowledge that you are responsible for any amounts due on your account. We may include any relevant taxes in the amounts due. Payments are collected before or after the service is rendered, depending on the type of service provided.
Please note that you must adhere to the payment terms and settle amounts on time to ensure continued and proper use of the service.
The Dakatra program also reserves the right to modify or cancel any fees that may arise in the future. The application also offers discounts and promotional offers subject to their own terms and conditions. Please read and agree to the terms and conditions of offers and discounts before benefiting from them, and we reserve the right to modify or cancel them without prior notice.
Refund Policy: (Dakatra)
- Upon payment for booking any medical service, the user may cancel the service. As a result, a bank notification will be issued for a cash refund via the electronic payment method for the transaction, in accordance with legal procedures and within the time period committed to by each bank, without any intervention from the Dakatra application.
- In the future, the application may introduce alternative solutions such as an in-app digital wallet.
- If the patient does not attend their appointment after making an electronic payment, and fails to cancel the booking at least two hours before the examination time, they will be subject to an administrative fee of 15% of the examination fee and must notify the application management of their wish to obtain a refund.
